Terms of Use

These Terms of Use (the "Terms") define the rules for accessing and using the Tellyah application.

Tellyah is a space for expression and creation. These rules are designed to ensure a respectful, safe and balanced environment for all users.

This English version is provided for convenience. These Terms are governed by French law (see article 13): in case of discrepancy, the French version prevails.


1. Purpose of the service

Tellyah is an application that allows users to publish, read and interact with tellys and other creative content (texts, images such as illustrations, covers and profile photos, interactive choices, emos).

Use of Tellyah implies full and unreserved acceptance of these Terms.

This acceptance takes place before any use of the service: by tapping "Commencer à lire" ("Start reading"), by creating an account or by signing in, you acknowledge that you have read these Terms and you accept them. A link to these Terms is shown to you at each of these steps. If you do not accept them, you must not use Tellyah.


2. Access to the service

Access to the application is reserved for persons holding a user account.

Minimum age:

Use of Tellyah is reserved for persons aged at least 16.

Users declare on their honor that they have the required legal capacity.

Tellyah does not collect data that would allow identity verification, but reserves the right to suspend an account in case of serious doubt.

Tellyah is free to use. Some features may become paid in the future. Where applicable, users will be clearly informed before any subscription.


3. Account creation and management

Creating an account requires providing accurate and up-to-date information.

Each user is responsible for:

  • the confidentiality of their login credentials
  • the use of their account
  • the content published from it

Tellyah reserves the right to suspend or delete an account in case of non-compliance with these Terms.


4. Content published by users

Users may publish texts and images on Tellyah (bubble illustrations, telly covers, profile photo).

By publishing content, the user warrants that:

  • they are the author of the content, text or image, or hold the necessary rights
  • the content does not infringe the rights of others, notably the rights of third parties in an image the user did not create, and the image and privacy rights of persons depicted in a photograph
  • the content complies with applicable laws and these Terms

The following are notably prohibited:

  • hateful, discriminatory or violent content
  • defamatory content or content inciting hatred
  • content that infringes privacy
  • content constituting harassment, threats or intimidation
  • sexual content that is non-consensual or involves minors
  • images that are sexual, show nudity or depict graphic violence
  • images of identifiable people published without their consent
  • illegal or fraudulent content

Zero tolerance:

Tellyah applies zero tolerance to the objectionable content listed above, whether text or images, and to abusive users, meaning those who publish such content, harass or threaten other users, or misuse the service to cause harm. Such content is removed and its authors may be excluded from the service, in accordance with article 7.


5. Intellectual property

Content published on Tellyah remains the exclusive property of its authors.

By publishing content, the user grants Tellyah a non-exclusive, free, worldwide and transferable licence, strictly necessary for:

  • hosting and storing the content
  • displaying and presenting the content to other users
  • technically distributing the content within the application (web, mobile)
  • the technical reproduction and adaptation required for the service to work properly (e.g. creating thumbnails, optimisation)

Duration of the licence:

This licence ends when you delete your content or your account, subject to a reasonable technical delay, of at most 30 days, needed for the deletion to take effect.

Limitations:

Tellyah claims no ownership rights over your content and does not use it for commercial purposes without your explicit written consent. You keep all your copyright and may use your content as you see fit.


6. Rules of conduct

Tellyah is built on respect, kindness and freedom of expression.

Each user undertakes to:

  • respect other members
  • not use the platform for harmful purposes
  • not misuse the service

Any abusive behaviour may lead to moderation measures.


7. Moderation, reporting and blocking

Reporting:

Tellyah provides reporting mechanisms, available in the application, so that you can report inappropriate content, text or image, or behaviour. The Tellyah team is alerted to every report.

Commitment to review:

Tellyah reviews reports as promptly as possible. Following this review, the content concerned may be removed and its author excluded from the service.

Blocking:

You can block a user, from their public profile or from the menu of a telly. As soon as you block someone, their content no longer appears in your feed. The blocked person is not notified. You can unblock them at any time from the application settings. Each block is brought to the attention of the Tellyah team, which may take it into account when reviewing the behaviour of the user concerned.

Moderation measures:

Tellyah reserves the right to:

  • moderate
  • hide
  • delete content, text or image
  • suspend or delete an account, without notice in case of serious breach

Published texts and images may be analysed automatically to detect prohibited content, as set out in the Privacy Policy.

These actions are taken to preserve a safe and respectful space.


8. Liability

Tellyah provides the service as is.

Tellyah cannot be held liable for:

  • content published by users
  • indirect damages related to the use of the service
  • temporary interruptions or technical malfunctions

The user remains solely responsible for how they use the application.


9. Account deletion

Users may request deletion of their account at any time from the application settings, available from the profile page.

Deleting the account results in:

  • immediate deactivation of access to the service
  • deletion of your identifying personal data within 30 days at most

Fate of published content:

When your account is deleted, all of your published content (tellys, bookmarks) will be permanently deleted.

10. Personal data

The collection and processing of personal data are detailed in the Privacy Policy, available from the website and the application.

Tellyah undertakes to comply with the applicable data protection regulations.


11. Changes to the Terms

Tellyah reserves the right to modify these Terms at any time to reflect changes to the service or to regulations.

Notice of changes:

In case of a significant change (notably concerning your rights or obligations), you will be informed by a notification in the application.

Changes take effect upon notification, except for changes required by law, which may take effect immediately.

If you do not accept the new Terms, you may delete your account. Continued use of the service after the new Terms come into force constitutes acceptance of them.


12. Mediation and dispute resolution

Consumer mediation:

In accordance with article L. 612-1 of the French Consumer Code, you have the right to use a consumer mediator free of charge in case of a dispute.

13. Governing law and jurisdiction

These Terms are governed by French law.

In case of a dispute, and failing an amicable settlement or mediation, the French courts will have jurisdiction.
